So why is the FDA nervous that states are letting AI prescribe drugs? It's because states are quietly testing AI systems that can improve or renew prescriptions with minimal doctor involvement. And that raises real regulatory risk. I'm a pharmacist, I'm a lawyer, so I look at this from both sides, the medicine and the law, and both are flashing warning signs. First, there's the misdiagnosis risk. Studies already show that AI is guiding real health decisions and sometimes getting it wrong. When AI misses symptoms, care gets delayed. A state sandbox does not magically fix bad clinical logic. Second, liability confusion. If an AI refills a drug like you're seeing in Utah, a patient may be harmed. Who owns that decision? The software company? The pharmacy? The supervising clinician? States can waive rules, but they can't waive lawsuits.
